Instructions for Bad Check Recipients

Forms

Instructions

If you have received a bad check, please fill out the Complaint Form (or the Rental Complaint Form) and the Probable Cause Statement as completely as possible for each individual check. Failure to include some information may impact our ability to proceed. Please also submit these forms with the legal copy of the check and any video, photographs, or documentation for each check.

Missouri law states that you may not utilize both the civil courts and the criminal courts for the collection of the same check. If you submit a check to the Prosecuting Attorney's Office, you agree to cooperate fully with prosecution. You may be required to appear in court to testify in the event a criminal trial takes place. If we determine that the requirements for criminal prosecution are not met, we will return all of the checks, video and documentation to you.

After checks are referred to our office for collection, all payments on checks must be made to the Boone County Prosecuting Attorney's Office ONLY. If you refer a check to this office to collect on your behalf, do not accept payment or partial payment from the check writer. Instead, please refer that person to the Boone County Prosecuting Attorney's Office.

If you accept payment or partial payment for a check already referred to the Prosecuting Attorney's Office, we will return the check to you and all efforts to collect on your behalf will cease.

If you have any questions about procedure or other requirements, please do not hesitate to call this office at (573) 886-4100.
