Chairperson Trabue, called the meeting to order at 7:00 p.m. in the Boone County Chambers having a quorum present.

Chairman Trabue explained the function of the Board of Adjustment. He stated that all decisions are based upon the Boone county Zoning and Subdivision Regulations, which are considered to be part of the record of the proceedings.

Member Rootes made and Member Bossaller seconded a motion to approve the minutes of December 2, 1999 meeting with no corrections. Minutes were approved by acclimation.

 

 

REQUEST

  1. Request by Steven D Stark to place a pre-1976 mobile home on 11.51 acres located at 9700 Van Court Rd, Hallsville.
  2. Bill Florea gave the staff report that the current zoning of the property is A-2 Agriculture. All adjacent zoning is also A-2. This property is located about 3 miles southeast of Hallsville. Currently there is an old basement house on the property. The applicant plans to use it for storage. The requested variance is to place a 1972 mobile home on the property to live in during construction of the new home.

    The original zoning for this tract is A-2. There have been no previous requests submitted on behalf of this property. Staff notified 20 property owners of this request.

    Steven Stark, 107 Edgewood, Hallsville 65255. Plans to put a singlewide trailer on his property for temporary dwelling until he has built the new house. He already has a buyer for the trailer so there will not be a problem have it removed upon completion of the house.

    Bill Florea stated that one neighbor had responded to the request. He had a question on the address, because the address conflicted with a neighboring property. Mr Florea said that is something that the Staff can work out.

    Mr Stark has owned the property since June 1999. There is a basement house on the property, which needs major repairs before it can be lived in or used for storage. Plans to build new home the later part of this year and will use the old basement house for storage once it has been repaired.

    Chairman Trabue explained the safety issues with pre-1976 mobile homes. Concerns regarding window sizes for emergency exits and proper wiring. Mr Stark acknowledged that the trailer has copper electrical wiring. Pictures were submitted for review of window sizes and heights.

    Member Keil made and Member Rootes seconded a motion to approve a 2-year variance as requested by Steven D Stark to place a pre-1976 mobile home on 11.51 acres located at 9700 Van Court Rd, Hallsville.

  3. Request by Eva Dean Gibson to permit a mobile home as a second dwelling on 1.05 acres, located at 10450 Flynt Ln., Hallsville.

Thad Yonke gave staff report that the applicant owns this lot and the adjoining lot (1.07 acres), which is in Hartley Subdivision. The original zoning for this tract is A-R. The current zoning for this tract is still A-R. The adjacent zoning is A-R (Agricultural Residential) and A-2, which is Agriculture 2. The site is located 3.5 miles southeast of Hallsville.

The original zoning for this tract is A-R. Hartley Subdivision was platted in 1973. In 1991, the applicant received a conditional use permit to place a mobile home on this lot. At the same time, she also received a permit to allow her son to place a mobile home on the adjoining lot. The variance is for a mobile home as a temporary dwelling unit for a medical hardship for a family member. Staff notified 23 property owners.

Jerry and Eva Dean Gibson, of 10450 Flynt Lane, Hallsville. Mr Gibson addressed the Board members. The applicants have obtained a variance on the setback from the Health Department for a second lagoon on the property. Mr Gibson has made arrangements for all utilities at the site. He also stated that whenever the need for the second dwelling was gone everything would be put back the way it was originally.

Staff received no comments from surrounding neighbors. Staff does have a medical letter and pictures and letter of verification of variance from the Health Department. Chairman Trabue asked staff to reread the staff report for clarification of the request.

Member Rootes made and Member Keil seconded a motion to approve a 2-year variance as requested by Eva Dean Gibson to permit a mobile home as a second dwelling on 1.05 acres, located at 10450 Flynt Lane., Hallsville.

OLD BUSINESS

Stan Shawver informed the Board Members that the McFarlands did receive their notice for renewal. However, the McFarlands stated that they were in the process of removing the mobile home from the property because they no longer need the permit.

Mr Shawver commented that the permit was used for one 2-year period.

Thad Yonke gave the following staff report This site is located on West Dothage Road approximately 4 miles southwest of Columbia. There is a residence currently on this property. The zoning is A-1 (Agriculture). All of the adjoining zoning is A-1 (Agriculture). The requested variance was to place a mobile home on the property to assist the mother. The original zoning was A-1 and the request was approved in January 1998. Essentially it is the second dwelling for a medical hardship. Staff notified 5 property owners.

Robert Perkins of 3910 W Dothage Rd, Columbia, was present. He stated that the situation is the same. His mother is still there and needs their help. He asked that the permit be renewed.

Staff received no comments from surrounding neighbors. It appears that the conditions of the original request have remained the same.

Member Bossaller made and Member Keil seconded a motion to approve the renewal of 2-year variance permit issued to Robert L Perkins for a mobile home as a second dwelling for a family member on 4.0 acres located at 3900 W Dothage Rd., Columbia.
