Chairman Schneider, called the meeting to order at 7:00 p.m., with a quorum present. Roll call was taken by Noel Boyt, Secretary.

Minutes of June 20, 1995 were reviewed. Board Member Kirkpatrick moved and Board Member Keil seconded a motion to approve the minutes. Motion was approved by acclimation.

Chairman Schneider made procedural statement explaining Board procedures.

NEW BUSINESS

1. Request by Kathy Grindstaff to allow a pre-1976 mobile home to be placed

on .79 acres located at 9360 S. Smith Hatchery Rd., Columbia.

Chairman Schneider asked Director Shawver if the only reason this request was before the Board was due to the fact that the mobile home was pre-1976. Director Shawver stated that was correct.

Ms. Kathy Grindstaff, property owner, approached the Board. She stated she understood one of the problems with an older mobile home was the fact that they have aluminum wiring. She stated that this particular mobile home does have copper wiring in it. She said she had contacted all but one of the area residents notified. The residents had signed a statement that "Being a property owner within 1,000 ft, I have no objection to allowing Kathy Grindstaff to place a pre-1976 mobile home on .79 acres at 9360 South Smith Hatchery Road, Columbia". She stated all signatures were on the petition except for hers and a Mr. Peters. She said she could not catch him at home.

Chairman Schneider accepted that into the record. He asked Ms. Grindstaff to describe the condition of the mobile home. Ms. Grindstaff asked Susan Larkin to approach the board and describe the mobile home since it belonged to her.

Susan Larkin approached the board. She stated she thought it was in "great shape". She did not want to trade it for a new one. She stated it had been repainted and she was going to paint it again simply because she did not like the color of it when she got it.

Ms. Grindstaff stated that Ms. Larkin was on a medical disability. She understood that financial hardship was not one of the areas considered by the board, but it would cost Ms. Larkin much less to live there. Other than utilities that would be the only expenses for her.

Chairman Schneider opened discussion to the public. No one spoke in favor or opposition.

Member Kirkpatrick stated he had no questions but as it was pointed out, the main reason to come before the Board was the age of the mobile home and the fact that if built before 1976 (before national code) there were safety concerns.

Chairman Scneider stated that the ordinance delegated this overview to this board primarily to retire the exceptionally obsolete mobile homes in the county. This 1972 unite would not appear to come under that category. He did not object to the request.

Member Kirkpatrick moved and Member Trabue seconded motion to approve request by Kathy Grindstaff to allow a pre-1976 mobile home at 9360 S Smith Hatchery Rd., Columbia.

Voting was as follows:

2. Request by Dr. Randall Trecha to allow construction 16’ from the road

right-of-way for property located at 6986 South Shore Dr., Hartsburg.

Dr. Randall Trecha addressed the board. He stated he lived out at Lake Champetra, close to Hartsburg, with private roads having 50’ ft. right-of-way. He wanted to construct a gazebo on one portion of the lot. His lot No. 9 is split by South Shore Drive. His lake access is on the smaller plot. He would like to construct a 12’ ft. by 12’ ft gazebo for sitting and eating and such down by the water. He stated there were covenants in Lake Champetra Home Owners Association. He stated this type construction had to be approved by the Home Owners Association. Dr. Trecha submitted the request to the association and their reply to the board.

Chairman Schneider accepted request and reply.

Dr. Trecha advised in his original submission there was a small map where the gazebo would be, but at that time he did not have the actual distances indicated. He submitted a sketch of the property and the distances to South Shore Drive. He stated the actual paved surface of South Shore Drive was 19’ ft. wide, the right-of-way was 50’ ft. He stated there were several structures around the lake that were within the 50’ ft. right-of-way. He wanted to tuck the gazebo behind a stand of large trees.

Member Kirkpatrick asked if this was a highly maintained road on a dedicated public highway. Director Shawver answered that the right-of-way is public, but that the roads are maintained by the homeowners..

Chairman Schneider opened discussion to the public. No one spoke in favor or opposition to the request.

Chairman Schneider spoke of the letter from the Lake Champetra Home Owners Association that approved the construction of the gazebo on April 21, 1995. Chairman Schneider asked Dr. Trecha if the road separated the bulk of his lot from the place he wants to build the gazebo.

Member Kirkpatrick asked what was the small structure that is 12’ ft. from the gazebo site as shown on the site map? Dr. Trecha stated it was a drainage culvert that ran under the road.

Member Kirkpatrick stated that as the aerial photograph would indicate, setbacks around the lake are a real horror story. There are so many that are out now they could not be fixed. He stated it was a nice area just not developed in an orderly manner. Chairman Schneider stated encroachments are the rule rather than an exception.

Member Trabue stated he thought this was a very appropriate use of the property, given the present road situation even if they were to widen the road, it would not impact the area being discussed.

Member Trabue made and Member Keil second motion to approve request to allow construction 14’ ft. from the right-of-way for property located at 6986 South Shore Dr., Hartsburg.

OLD BUSINESS

Review permit issued to Jimmy Ray Rippeto for a mobile home as a second

dwelling on 2.0 acres , located at 15505 Wren School Road, Hartsburg. (6/85)

Betty Rippeto, mother of Jimmy Ray Rippeto approached the board.

Director Shawver advised the original request of Jimmy Ray Rippeto had a house on the property located on Wren School Rd., near the intersection of Calvin Dr., Hartsburg mailing address. It is west of Ashland about 3 miles. There is an old house on the property that Jimmy lives in, a mobile home was placed on the property to be occupied by his mother Betty Rippeto. She is there and helps take care some grandchildren.

Chairman Schneider verified that the children still live on the property. He continued that the situation in 1985, still exists. Mrs. Rippeto stated yes.

Member Keil asked Director if there had been any problems? He stated none.

Open to public hearing. No one spoke in favor or opposition.

Member Keil made and Chairman Schneider second motion to renew permit for two (2) years for a mobile home as a second dwelling on 2.0 acres, located at 15505 Wren School Rd., Hartsburg, MO.

2. Review permit issued to Billy Lindsey to place a mobile home as a second

dwelling on 6.10 acres located at 920 E. High Point Lane, Columbia (7/78).

Director Shawver stated that it was originally granted for Mr. Lindsey’s mother. Property on

High Point Lane, approximately 2 miles south of Columbia. Not very far from Rock Bridge State Park. Mr. Lindsey’s house is on the property and the mobile home was placed there for his mother.

Chairman Schneider asked Mr. Lindsey if his mother was still residing there? Mr. Lindsey stated yes, she was.

Mr. Lindsey asked that if something happened to his mother, how may days did he have to dispose of the trailer? Chairman Schneider stated there was no set rule. He thought a couple of months would be reasonable.

Mr. Lindsey stated when he first was granted the permit, he was advised he had 45 days to dispose of the trailer. He said 45 days was not very long at all. Chairman Schneider stated that it is not a hard and fast rule. The main reason is not to let someone else move into the second dwelling. Mr. Lindsey said he was not going to have anyone move in next to him.

Member Kirkpatrick made and Member Trabue second motion to renew permit for two (2) years issued to Billy Lindsey to place a mobile home for 2nd dwelling on 6.10 acres located at 920 E. High Point Lane, Columbia.

Voting was a follows:

3. Review permit issued to Charlotte Allen for a second dwelling on 2.33 acres

located at 5150 S. Scott’s Blvd., Columbia (8/80).

Mr. David Allen approached the board.

Director Shawver advised the property was just west of the city limits on Scott’s Blvd. Her mobile home is on the property. In 1980, she lived with her son David. She wanted to place a second dwelling on the property for her elderly aunt since they were the only remaining relatives. Subsequently her son moved into the trailer and aunt moved in with Charlotte Allen to provide closer care. The situation has remained the same. Charlotte is retired now with health problems of her own to the point where she is on oxygen all the time. That is why David Allen is here to represent her.

Chairman Schneider asked David Allen that basically he was helping both his mother and the aunt. Mr. Allen stated yes.

Chairman Schneider stated that the fact that Charlotte and the aunt live in the same mobile home did not changed the situation.

Chairman Schneider moved and member Trabue seconded motion to renew permit for 2 years issued to Charlotte Allen for a second dwelling on 2.33 acres located at 5150 S. Scott’s Blvd.

Member Trabue made motion to close nomination and for Tom Schneider be elected by acclimation, Member Kirkpatrick seconded.
